Grounds for Divorce: The court shall grant a no-fault divorce upon a finding that "there has been a breakdown of the marriage relationship to the extent that the legitimate objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved. [Iowa Code]
Residency Requirements: "The petitioner has been for the last year, a resident of the state and the maintenance of the residence has been in good faith and not for the purpose of obtaining a marriage dissolution only." The petition shall be filed in the county where either party resides and "no decree dissolving a marriage shall be granted in any proceeding before ninety days shall have elapsed from the day the original notice is served, or from the last day of publication of notice, or from the date that waiver or acceptance of original notice is filed or until after conciliation is completed, whichever period shall be longer", except upon a showing of emergency or necessity.
